There are some issues that have to be beyond ideology and Aboriginal Land Justice fits firmly into this category.
Foreward by Senator Cheryl Kernot: When the High Court handed down its decisions in both the Mabo and WIk cases, it also handed the nation an opportunity. That opportunity was for reconciliation with indigenous Australia.
Foreward by Jack Wateford: The High Court's decision in the Mabo case was a landmark in Australian history. The court struck out two centuries of a legal lie - the assumption that the land upon which British colonists had settled was an empty land, or one occupied only by barbarians. The abolition of the legal fiction was a great moral victory for Aborigines, but whether and to what extent it provided fresh opportunities for them was a matter of considerable debate. There were some whose fury at the decision seemed based merely on resentment about the overthrow of the settled, if plainly false, jurisprudence. But there were other non-Aboriginal Australians who feared that the decision could affect their power and control over land which they occupied. ... This book is an essential companion to the debate going on.

Chapter 1: Matters of History. What is Native Title? Legal fictions. It was all easy before Eddie Mabo came along. Australian governments and courts had a perfectly workable and consistant sytem of land law and tenure which, despite the inevitable disputes and occasional modifications, had stood them in good stead since 1788.
