Could selling a used book become illegal?

Kirtsaeng – a case expected to come before the Supreme Court early next year – could make it illegal for non-profits and businesses to resell copyrighted works produced abroad.

Looking at the article this seems to be about used books being resold in USA. Is there any suggestion that this would have implications elsewhere? Or beyond books?

The real reason behind the prosecution doesn't seem to be so much about reselling books in general, but doing so to circumvent publishers' differential prices policies in different markets.
Since that practice is hardly anything new (and e-books DRMs allow it to bloom without that many people making a fuss) and applies to many more areas than book publishing (see computer hardware and software) I'm surprised they would want do fiddle with that "first trade" notion. Aren't there other more direct legal tools ?

I doubt any foreign-produced book in the USA is going to be made untradeable just to humor them.
